The need for this situation to be put forward for Private Prosecution is the only remedy to bring resolution to this travesty. The police are the Crown, so is the Local Authority plus the Courts. Is it fair the Crown is investigating the Crown in this situation, no it is not? It would be very hard to trust any investigation invoked by the said authorities. This entire situation needs to be removed as mentioned. The right to bring private prosecutions is to be found in section 6(1) of the Prosecution of Offences Act 1985. Anyone can bring a private prosecution in principle, however, there some limitations on the power. The Director of Public Prosecutions (DPP) has authority under section 6(2) of the 1985 Act to take over private prosecutions. There is no requirement for the CPS to take over a private prosecution, but there will obviously be instances where it is appropriate for the CPS to exercise the Director’s powers under section 6(2), this could be to continue the prosecution, discontinue the prosecution or stop it. There are services out there for this case maybe pro bono or private, but in the interests of the named children and every child every avenues has to be looked at to save further depraved crimes.
